Enduser Conduct Poicy
Version 5:
If you believe one of our Customers or End Users has violated this policy, please contact us at michael@peaky.io and provide as much detail as possible to assist with our investigation.
Peaky ApS ("Peaky", "we", "us", "our") provides a web-based leadership and employee-engagement platform that allows our Customers (organisations) and their End Users (employees, managers and administrators) to share wellbeing and engagement signals, reflections and insights, and to support day-to-day leadership. The vast majority of this use is constructive and benefits everyone involved. However, there are times when a Customer or End User may use the Service in ways that are objectionable or harmful. We have developed this End User Conduct & Content Policy ("Policy") to make clear that such use is prohibited.
This Policy is incorporated into the Peaky Terms and Conditions and Licensing Agreement (together, the "Agreement") and outlines prohibited use, conduct and content on the Service. It applies to all Customers and End Users who access and use the Service. Notwithstanding the Agreement, Peaky may, in its sole discretion, suspend or terminate an account immediately and without prior notice due to a violation of this Policy.
We encourage all persons to report suspected violations of this Policy. There may be instances where we are limited in how we can respond, but we want to know about the activity. You also agree that if you learn of any unauthorised or unacceptable use of any account, Customer data or the Service, you will promptly contact Peaky and take reasonable steps to cooperate with us in addressing it. Capitalised terms used in this Policy but not defined here have the meaning given to them in the Agreement.

End Users may not:
Access or tamper with the Service, or engage in unauthorised access to the Service, including Peaky's computer systems or the technical delivery systems of Peaky or its service providers

Illegal and fraudulent activities
The Service may not be used to engage in dangerous, illegal, or fraudulent activities, or to directly or indirectly promote such activities. This includes violating the privacy rights of any person, infringing the intellectual property rights of others, publishing other people's private and confidential information without their permission, or unlawfully collecting other people's personal information. If Peaky suspects a Customer is using the Service to conduct or support fraudulent or illegal activities, it may suspend or terminate the Customer's account.
Harassment, bullying and harmful content
The Service is intended to support a healthy and psychologically safe working environment. It may not be used to engage in abusive, harassing, bullying, threatening or discriminatory behaviour, including in free-text reflections and feedback, and including when contacting Peaky employees, agents or suppliers. The Service may not be used to promote or normalise hate, violence, or hateful activities against individuals or groups. The Service may not be used to distribute content that contains nudity, graphic sexual acts, or sexually explicit material.
End Users should not submit special category data (such as health information) through free-text fields unless explicitly required and lawful. The Service is not designed to collect such data.
Deceptive behaviour and account integrity
The Service may not be used to deceive individuals or impersonate other individuals or organisations. This includes falsely implying any sponsorship or association with Peaky, creating a false or forged identity or email address, or otherwise misleading others as to the identity of the originator or source of a communication. Accessing another account without the permission of the account owner, or using the Service for phishing, is prohibited.
Reporting and enforcement
If any person suspects that a Customer or End User is engaging in conduct that violates this Policy, please report it to Peaky at michael@peaky.io. Peaky may be limited in its ability to investigate activity occurring outside the Service, and may require that the reporting person work with law enforcement where appropriate before we are able to take action on a reported account.
